Terms of Service

By using Marit.es ("the Service"), you agree to these Terms of Service. Please read them carefully before using the Service.

1. Acceptance of Terms

By accessing or using Marit.es at app.marit.es, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Marit.es is a third-party Tesla vehicle monitoring and management application. It connects to your Tesla account via Tesla's official Fleet API to provide vehicle status, history, and remote command features. Marit.es is not affiliated with or endorsed by Tesla, Inc.

The Service is offered in two editions:

• Marit.es Core — a full-featured paid edition including drive history, charge history, sentry history, stats, geo-fences, and advanced notification controls.
• Marit.es Lite — a free, ad-supported edition providing live vehicle status and sentry push notifications. The Lite edition may display banner advertisements from third-party ad networks.

3. Account and Access

• You must have a valid Tesla account to use Marit.es.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must be 18 years of age or older to use the Service.
• You grant Marit.es permission to access your Tesla vehicle data and execute commands on your behalf via the Tesla Fleet API, for the purpose of providing the Service.
• You may revoke this access at any time from your Tesla account settings.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Attempt to reverse engineer, decompile, hack, or disrupt the Service.
• Use the Service in a way that could damage your vehicle or violate Tesla's Terms of Use.
• Share your account credentials with other persons or attempt to access other users' accounts.
• Circumvent any rate limiting, access controls, or security measures of the Service or the Tesla Fleet API.

5. Vehicle Commands

You are solely responsible for any vehicle commands you initiate through Marit.es. The Service executes commands only upon your explicit request. We are not liable for any consequences resulting from vehicle commands issued via the app, including but not limited to vehicle damage, security incidents, or violations of local laws or Tesla's policies.

6. Marit.es Lite — Ad-Supported Free Tier

Marit.es Lite is provided free of charge and is supported by contextual banner advertisements. By using Marit.es Lite, you acknowledge and accept that:

• Banner advertisements may be displayed within the app.
• Ad content is provided by third-party ad networks and is not controlled by Marit.es.
• Your personal vehicle data is not used for ad targeting. See our Privacy Policy for details.
• You may upgrade to Marit.es Core at any time to remove ads and access all features.

7. Marit.es Core — Paid Subscription

Marit.es Core is a paid service. Pricing and billing terms are displayed at the point of purchase. For users in the European Union:

• You have the right to withdraw from a purchase within 14 days under the EU Consumer Rights Directive, unless the digital service has already been fully performed with your prior consent and acknowledgement that you lose the right of withdrawal upon full performance.
• Refund requests should be directed to [email protected].

8. Intellectual Property

The Marit.es application, website, and associated materials are the property of Marit.es and its contributors. The vehicle monitoring engine is based on TeslaMate and is published as open source under the GNU Affero General Public License v3.0 (AGPL-3.0) at github.com/RaNd250/marites-backend. The proprietary application layer, Android apps, and website are not open source and may not be reproduced, distributed, or used to create derivative works without permission.

9. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We do not guarantee uninterrupted or error-free service. Vehicle data accuracy depends on Tesla's API and may not always reflect real-time conditions. We are not responsible for any decisions made based on data displayed in the app.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Marit.es shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, which cannot be excluded by law.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, without notice. You may stop using the Service at any time by revoking Tesla API access from your Tesla account settings and contacting us to delete your account.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Greece and the European Union. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Greece, without prejudice to your rights as a consumer under the laws of your country of residence within the EU.

13. Dispute Resolution

We aim to resolve disputes amicably. If you have a complaint, please contact us first at [email protected]. EU residents may also use the EU Online Dispute Resolution platform for out-of-court resolution of consumer disputes.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
